Remaining lease on Port Klang and Pulau Indah industrial land: expiry, leasehold renewal and consent
Ms Teh Seok Hoon, PEA 4006. Updated
Most industrial land around Port Klang is leasehold, so count the years left from the expiry date on the title, not from the "99-year" label. In Selangor an owner can apply to extend the lease before it ends; the state decides and charges a premium of 3/4 x 1/100 x approved land value x years added x area for industrial land. Space in PKFZ is rented from PKFZ itself, so there the term in your agreement is what counts.
Key takeaways
- State land is alienated for up to 99 years or, only in limited cases, in perpetuity, which is why port-area industrial titles are mostly leasehold; a 7.31-acre Pulau Indah Industrial Park plot sold in October 2025 was on a 99-year lease.
- Read the expiry date on the title or an official search (Carian Rasmi, valid one month) and work out the years left at the date you plan to sell or refinance.
- An extension is applied for before expiry, is at the state's discretion, and for industrial land in Selangor costs 0.75% of the approved land value for each year added.
- Many titles carry a restriction in interest, so a transfer, charge or lease needs state consent; Selangor processes it fully on e-Tanah since 26 October 2024.
- In the Port Klang Free Zone you rent from PKFZ Sdn Bhd, a Port Klang Authority subsidiary, so check the term of your agreement rather than a land title.
- Longest state lease
- 99 years (National Land Code s.76)
- Example in Pulau Indah Industrial Park
- 7.31 acres, 99-year leasehold, RM25.2 million (Oct 2025)
- Selangor premium, industrial extension
- 3/4 x 1/100 x approved land value x (new term minus years left) x area
- Applying in Selangor
- PLTP on e-Tanah since 26 Oct 2023
- Consent letter valid
- 3 years from approval
- PKFZ space
- Rented from PKFZ Sdn Bhd; open-land leases of up to 30 years under study (2026)
Why most port-area industrial land is leasehold
Under section 76 of the National Land Code the state alienates land either for a term not exceeding 99 years or in perpetuity, and perpetuity is limited to land for the Federal Government or a public authority, land for a public purpose, and special circumstances the state accepts. Industrial land opened up around the port in recent decades has therefore mostly been granted on leases.
Pulau Indah shows the pattern. In October 2025 Colform Group bought a 29,595 square metre (7.31 acre) site in Pulau Indah Industrial Park from Central Spectrum (M) Sdn Bhd for RM25.2 million, and Business Today reported it as 99-year leasehold industrial land; the New Straits Times also described it as leasehold. A 99-year label tells you the original term, not the years left: a lot alienated decades ago has used up part of that term.
The port areas themselves are run on time-limited terms too. Westport operates under a concession that was extended in December 2023 for 58 years to 2082, as Free Malaysia Today reported. On the mainland, Northport's concession expired on 30 November 2013, it ran under an interim agreement from March 2014, and it received a 30-year extension in 2018, according to the New Straits Times. Expiry dates matter all around the port, not only on factory titles.
The Port Klang Free Zone works differently again. PKFZ Sdn Bhd is a subsidiary of the Port Klang Authority, and its chief executive told Bernama, via the New Straits Times, in July 2026 that smaller tenants take one to three-year terms and that PKFZ is considering turning about 20 acres of light industrial units into open-land leases of up to 30 years. In PKFZ you do not buy a land title; your rights run for the term of your agreement with PKFZ.
How to read the years left on the title
Ask for a copy of the title early and have your lawyer pull an official search (Carian Rasmi) before you sign. The Selangor land office says an official search is valid for one month, so a search from last year does not show today's position. Under section 120 of the National Land Code every express condition and restriction in interest must be endorsed on or referred to in the title, so the same document tells you the term, the land use and whether consent is needed.
Then do the arithmetic yourself:
- Take the expiry date on the title, not the original term, and count the years left today.
- Count again at the date you expect to sell, refinance or move out: that is the lease the next buyer or bank will judge.
- Note any restriction in interest (the usual wording says the land may not be transferred, leased or charged without state consent).
- Check the category of land use and express conditions match your operation, since an extension application keeps the same category and conditions unless you also apply to change them.
- For a unit you rent, ask for the landlord's title too: your tenancy cannot run past the landlord's own lease.
How a lease extension works in Selangor
Section 90A of the National Land Code lets the registered owner apply to extend the term, and the application must be made before the expiry date on the title. The state will not consider it unless everyone with a registered interest, such as a chargee bank, has consented or their consent is dispensed with. Approval is at the state's discretion and can carry a premium; once approved, the land administrator serves a Form 5A notice, and if the sum is not paid within the time stated, the approval lapses.
Selangor told its state assembly in 2017 that section 90A has applied there since 1 January 2017, so an extension can be done in one dealing without first surrendering the land; the older route of surrender and re-alienation under sections 197 and 76 remains, and land whose lease has already expired can still be considered for a new lease of up to 99 years under section 76 (Dewan Negeri Selangor). A 2014 answer said the extension for an expired lease is 99 years or depends on the land use applied for (Dewan Negeri Selangor).
Since 26 October 2023 the Selangor land office takes lease extension applications (Permohonan Lanjut Tempoh Pajakan, PLTP) through the e-Tanah public portal. After applying online, the owner prints the slip and brings it, with the signed form and the documents on the checklist, to the district land office within 30 days; the State Authority approves (Pejabat Tanah dan Galian Selangor). For Port Klang, Pulau Indah and Kapar, that district land office is Klang.
State consent to transfer, charge or lease
When a title carries a restriction in interest, a sale, a charge to a bank or a registered lease needs the state's consent first. Since 26 October 2024 Selangor handles consent fully on e-Tanah, from filing and payment to the decision letter. Its published times are 14 working days for a transfer decided by the land administrator, and 14 working days at the district plus 14 at the state land office where the Menteri Besar decides; consent to lease and to transfer a lease sit with the Menteri Besar, and a consent letter is valid for three years from approval (Pejabat Tanah dan Galian Selangor). Build that time into the completion date in the sale agreement.
Tenants should know the line between a tenancy and a lease. Under the National Land Code, tenancies of up to three years are exempt from registration, while a registered lease runs for more than three years, up to 99 years for a whole lot and 30 years for part of one. A longer lease over a warehouse in Pulau Indah or Westport can therefore need both registration and, where the title is restricted, state consent to lease.
Foreign individuals and companies need prior state approval to buy land in Selangor under section 433B, and the Selangor land office lists foreign purchase, foreign tenancy and the matching release of restrictions under the Director of the state land office.
What a short remaining lease changes
A lease that runs down has three practical effects, all of which follow from the rules above. The cost of topping it up rises with every year that passes, because the premium is charged on the years added. A bank lending against the land is lending against a security that returns to the state at expiry unless extended, so it will look at the years left at the end of its loan; each bank sets its own rule, so ask yours in writing before you make an offer. And the next buyer faces the same questions with fewer years.
None of this makes a leasehold unit near the port a poor choice for an operator; it means the price, the loan and the exit should all be worked out on the years you will actually have. Our leasehold buying checklist covers the steps from offer to completion, and the Pulau Indah Industrial Park data on FactoryHub shows the park's registered activity. For units on the island, see industrial land for sale in Pulau Indah, and for the wider port belt, Port Klang. Ms Teh can help you check the title, the years left and the consent position on units in these areas before you view.
Questions buyers and tenants ask
How much does it cost to renew a leasehold industrial lot in Selangor?
Selangor's published formula for industrial land is 3/4 x 1/100 x the approved land value x the years added x the area, about 0.75% of the land value for each year added. Topping a lot with 40 years left back to 99 years would cost about 44% of the approved land value. Confirm the value and rate in force with the land office or your lawyer.
What happens after 99 years of leasehold in Malaysia?
The land returns to the state unless the lease was extended before expiry under section 90A. In Selangor the original owner of land whose lease has already expired can still be considered for a new lease of up to 99 years under section 76, on payment of a premium, but approval is at the state's discretion.
Is land in the Port Klang Free Zone (Zon Bebas Pelabuhan Klang) freehold or leasehold?
Neither, for an occupier: PKFZ space is rented from PKFZ Sdn Bhd, a Port Klang Authority subsidiary. Smaller tenants take one to three-year terms, and in July 2026 PKFZ said it was considering open-land leases of up to 30 years on about 20 acres. Your rights run for the term of your agreement.
Is Pulau Indah Industrial Park (Taman Perindustrian Pulau Indah) leasehold?
Reported deals say so: the 7.31-acre plot Colform bought there in October 2025 for RM25.2 million was 99-year leasehold. Terms and expiry dates can differ lot by lot, so read the title of the lot you are looking at.
How long does state consent take in Selangor?
The Selangor land office publishes 14 working days for a transfer decided by the land administrator, and 14 working days at the district plus 14 at the state land office where the Menteri Besar decides, with complete documents. A consent letter is valid for three years.
Can I rent a warehouse near Westport for longer than the landlord's lease?
No. A landlord can only grant rights within its own title, so ask for the title and check the expiry date covers your term and any renewal options. A lease of more than three years is registrable under the National Land Code and may need state consent if the title is restricted.
